It is the intent of the parties that, barring extraordinary circumstances, arbitration proceedings will be concluded within one hundred and twenty days from the date the arbitrator is appointed. The arbitrator may extend this time limit in the interests of justice. Failure to adhere to this time limit shall not constitute a basis for challenging the award. Except as may be required by law, neither a party nor its representatives may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. The Parties shall exchange a copy of all exhibits for the arbitration hearing and shall identify each witness who will testify at the arbitration, with a summary of the anticipated testimony of such witness ten days before the arbitration hearing. The arbitrator shall have no authority to award punitive/consequential/special/indirect damages. The arbitrators shall not be entitled to issue injunctive and other equitable relief.
The arbitrator shall award interest from the time of the breach to the time of award at the rate of 2%. The cost of the arbitration proceeding and any proceeding in court to confirm or to vacate any arbitration award, as applicable (including, without limitation, reasonable attorneys’ fees and costs), shall be borne by the unsuccessful party, as determined by the arbitrators, and shall be awarded as part of the arbitrator’s award. It is specifically understood and agreed that any party may enforce any award rendered pursuant to the arbitration provisions of this Section by bringing suit in any court of competent jurisdiction. The World History End of Course Exam is scheduled for May 8, 2013. We are in Level 1 of the Phase-in process. Students will be given a test of 68 test questions and an additional 20 questions for field testing this year.
They must have a raw score of 3500 to be considered passing for this exam. Students will take 3 exams for Social Studies: World History, World Geography and US History. Prior to graduating, students must have a CUMULATIVE SCORE or average over 3500 to receive credit from the state. Anything lower than a 3326 Combined Average, will not count. Students are allowed an indefinite number of re-testing opportunities before they graduate, and they are encouraged to take the exam more than once in order to increase their overall score and comprehensive average. Students will need to pass the exam - giving them a credit towards graduation.
